The Prosecution of Bosnia and Herzegovina files an Indictment for Genocide Filed

The Prosecution of Bosnia and Herzegovina files an indictment against Nedjeljko Milidragovic and Aleksa Golijanin, charging them with genocide in Srebrenica in July 1995.

“Milidragovic and Golijanin are not available to prosecution bodies of Bosnia and Herzegovina, but they were examined in Serbia prior to the filing of the indictment,” the State Prosecution confirmed to BIRN-Justice Report.

According to the charges, Milidragovic, former Commander of a squad with the Jahorina Training Centre of the Special Brigade of Republika Srpska, RS police, and Golijanin, former Deputy Commander of a squad with that Centre, committed genocide in the period from July 10 to 19, 1995.

The indictment alleges that, during a search of the Potocari area on July 12 Milidragovic killed a disabled Bosniak man, separated a group of between 15 and 20 men from “the white house” and killed them on a nearby meadow.

The Prosecution of Bosnia and Herzegovina alleges that Milidragovic ordered the execution of about 100 prisoners in the warehouse of the Kravica Agricultural Co-operative, Bratunac municipality and killed two prisoners, who surrendered on the road leading from Bratunac to Konjevic Polje.

It is further alleged that, following the capture of about 50 Bosniak men and boys, who were then escorted to the road, Milidragovic separated a boy aged between ten and 13 and ordered a soldier to take him away and kill him. According to the charges, they tied the hands of the remaining captives on their backs and Milidragovic then escorted them to a building in Konjevic Polje. The men have been missing without trace since.
Milidragovic’s place of residence and temporary residence are in Belgrade. He has citizenship of Serbia, just like Golijanin, whose place of residence is in Sremska Kamenica, Serbia.

According to the State Prosecution’s charges, Golijanin is charged with having been responsible for the Third Squad, as Deputy Commander. It is alleged that members of that Squad, who were armed with automatic guns, participated in the search of Bosniak houses with the aim of gathering people and escorting them to a collection centre in Potocari.

The indictment further alleges that Golijanin participated, along with other members of the First Company, in the forcible transportation, by buses and trucks, of the civilian population from the United Nations, UN Base in Potocari to the territory controlled by the Army of Bosnia and Herzegovina.

According to the charges, Golijanin participated in the capture of several thousands of Bosniaks. The Prosecution of Bosnia and Herzegovina alleges that Golijanin ordered members of the Centre to commit the execution of 15-20 captives on a meadow by the road between Konjevic Polje and Bratunac and personally participated in it.

It is alleged that, on July 17 and 18 he participated, along with other members of the Centre and Bratunac Brigade, in the search of a forest above the Bratunac-Konjevic Polje road, when at least four Bosniak men were killed. The Prosecution of Bosnia and Herzegovina charges Golijanin with having shot one of those men from close distance.

The indictment alleges that, during the search they captured several hundreds of Bosniak men, including boys, and escorted them to the warehouse at the crossroads in Konjevic Polje, where they were detained and then killed.

The indictment has been filed with the Court of Bosnia and Herzegovina for confirmation.
