WHAT IS A CONSTITUTIONAL CONVENTION AND HOW WOULD IT BENEFIT YOUR COMMUNITY

BY MERSINA ZILJKIĆ: The first constitutional convention is when the United States Constitution was finally signed and framed. If there were to be another constitutional convention in New York, these are the final proposals that I would want the elected delegates to discuss and develop.


A constitutional convention is a gathering where decisions are made about writing a new constitution or revising our already existing constitution. This convention is valuable because it is used to decide whether or not new or revised amendments should be passed onto the constitution to best accommodate this time period we live in.

Raising the age of criminal liability should be considered at the next constitutional convention. As of now in New York, children as young as 16 are being prosecuted as adults in the justice system. In adult facilities, juveniles are more susceptible to suicide, physical, emotional, and sexual abuse. According to New Jersey’s juvenile courts, “...youth in adult jails are thirty-six times more likely to commit suicide than those in juvenile detention facilities.” Not raising the age of criminal liability is resulting in more deaths of teenagers who are not at an age of maturity to be able to understand what they are doing. On the other hand, raising the age of criminal liability would not only save the lives of these teenagers, but it would give them time to grow physically and mentally and set themselves on the right path.

Another thing that should be considered is lowering the age of voting. Right now the voting age in New York is 18, but it should be lowered to age 16, when teenagers begin learning about politics and become interested in it. These young adults can be prosecuted as adults at the age of 16, but when it comes to their say in who will benefit the country they live in, they are

only seen as weak-minded children. If 16 year olds are “old enough” to be tried as adults in court and pay taxes to the government, then they are most definitely “old enough” to vote and have a say in who or what will be impacting their lives for the next few years.

In the state of New York, a judge’s mandatory retirement age is 70. I believe their mandatory retirement age should be increased to 80 since they are still able to remain in service on the court for up to 10 years past their mandatory retirement to fulfill the three terms they were appointed. This “requirement” was made for back in the day when old age really affected people’s work ethic due to disabilities, but now according to William E. Raftery, an Information Services Analyst, “Life expectancies and vitality are increasing…” Furthermore, judges should only be removed from their services if they are ill and cannot do their job appropriately and sufficiently.

An amendment that should be considered is permitting immigrants to become president. According to Dr. Steve Frank from Constitution Daily, “The Constitution requires that the president be at least 35 years old, have resided in the United States for at least 14 years and be a ‘natural born citizen’”. Ted Cruz responds to President Trump’s view on presidency and citizenship when he says, “The birther stories that Donald has been relying on, some of the more extreme ones, insist that you must not only be born on U.S. soil, but have two parents born on U.S. soil”, which should apply in his case since Trump’s mother was born in Scotland. On the other hand, if immigrants are allowed to serve in Congress and the military, they should be allowed to serve in the White House as president.

Another proposal that would be beneficial to everyone would be to repeal the 16th amendment, income tax. People being taxed on what they earn from working isn’t fair. Having income tax can actually discourage someone from working to earn a living. However, it would be more effective to tax on things a person has consumed or things they spend money on, not including the money that they are receiving. When being taxed on consumed goods, you can control how much money is being taken from you, but when there is an income tax, your money is basically being stolen from you before it even reaches the bank, which is something you cannot control.
